Terms of Use

1. About these Terms
These Terms of Use govern access to and use of the eclesi.com website, the app.eclesi.com web application and the Eclesi mobile app (together, the "Platform"), provided by Eclesi ("we").
By creating an account, accessing or using the Platform you confirm that you have read, understood and agree to these Terms and to the Privacy Policy. If you disagree with any part of them, do not use the Platform.
2. Definitions
- Organisation: the church, church network or entity that subscribes to the Platform and owns the account.
- Administrator: the person who creates the Organisation's account and grants the remaining access.
- User: anyone authorised to access the Organisation's account, including pastors, leaders, volunteers and members.
- Organisation Data: all content entered into the Platform by the Organisation or its Users — member records, groups, events, attendance, financial entries, receipts, feed posts and files.
3. Account and eligibility
To create an account you must be at least 18 years old and legally able to enter into a contract on behalf of the Organisation. The Administrator confirms they are authorised by the Organisation to accept these Terms.
You are responsible for keeping your credentials confidential and for all activity carried out with them. Tell us immediately about any unauthorised use.
The Organisation is responsible for defining and reviewing each User's permissions and for revoking access when someone leaves their role.
4. Use of the Platform
You agree to use the Platform only for lawful purposes consistent with running your Organisation. You must not:
- enter third-party data without an adequate legal basis or authorisation;
- use the Platform to send spam or content that is unlawful, defamatory, discriminatory or infringes third-party rights;
- attempt to access accounts, data or areas of the Platform without authorisation;
- reverse engineer, copy, resell or sublicense the Platform;
- run load tests, scans or automated attacks without our written permission;
- circumvent plan limits, access controls or security measures.
5. Organisation Data and data protection
Organisation Data belongs to the Organisation. We do not sell it, do not use it for advertising and do not share it with third parties, except as described in the Privacy Policy or as required by law.
For personal data processed inside the Platform, the Organisation acts as controller and Eclesi as processor under Brazilian Law 13.709/2018 (LGPD) and equivalent data protection rules. The Organisation defines the purposes of processing and must ensure a legal basis for the data it enters, including data about members, children and adolescents.
We process Organisation Data only to operate, maintain and improve the Platform, following the Organisation's instructions. We keep reasonable technical and organisational security measures, including encryption in transit, access control and periodic backups.
6. Plans, free trial and billing
The Platform is offered in plans priced by the Organisation's number of active members. The prices and limits in force are those published on eclesi.com at the time of subscription.
New accounts get a 30-day free trial with no credit card required. When the trial ends, access continues only with a paid plan.
Paid plans are billed recurrently and in advance, on the chosen cycle. Applicable taxes may be added. Non-payment may lead to suspension of access after prior notice.
We may change prices with at least 30 days' notice. The new price applies from the following cycle, and you may cancel before it takes effect.
7. Cancellation, suspension and termination
You may cancel your subscription at any time. Access remains until the end of the period already paid for, and there is no pro-rata refund for cycles in progress unless required by law.
We may suspend or terminate access in case of breach of these Terms, non-payment, risk to the security of the Platform or legal requirement. Whenever possible, we will notify you first.
After an account is closed, the Organisation has 30 days to export its Organisation Data. After that period the data may be permanently deleted from our active systems.
8. Availability and support
We work to keep the Platform continuously available, but we do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance, giving advance notice where there is a material impact.
Formal service level commitments (SLA) apply only where set out in a specific contract.
9. Intellectual property
The Platform, including its software, interface, brand, logos and documentation, belongs to Eclesi and is protected by applicable law. These Terms grant you a limited, non-exclusive, non-transferable and revocable licence to use the Platform for the duration of your subscription.
No rights over Organisation Data are transferred to us.
10. Confidentiality
Each party undertakes to protect the other's confidential information, to use it only for the purposes of these Terms and not to disclose it to third parties without authorisation, except where required by law.
11. Disclaimer of warranties
The Platform is provided "as is". To the maximum extent permitted by applicable law, we make no warranty that the Platform will meet specific requirements, will be error-free, or that the results obtained will be accurate or reliable.
The Platform is not a substitute for accounting, legal or tax advice. The Organisation is responsible for the accuracy of its records and for meeting its own legal obligations.
12. Limitation of liability
To the maximum extent permitted by applicable law, our total liability arising out of or relating to these Terms is limited to the amount actually paid by the Organisation in the 12 months preceding the event giving rise to the liability.
We are not liable for lost profits, lost opportunity, indirect damages, or for content entered by the Organisation or its Users.
Nothing in these Terms limits liability that cannot be limited by law, including liability arising from wilful misconduct or from consumer protection rules.
13. Changes to these Terms
We may update these Terms to reflect changes to the Platform or to the law. Material changes will be announced by email or inside the Platform at least 30 days in advance. Continued use after they take effect means you accept the new version.
14. Governing law and venue
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the Organisation's domicile are elected to settle disputes that cannot be resolved amicably.
